6-A. Lifelong and Irrevocable Neurocognitive Data Consent

By accessing, registering, or using any Services provided by PEAR NeuralTech Quantum Corp., you expressly, voluntarily, and knowingly grant to the Company a perpetual, worldwide, irrevocable, and non-revocable license and right to collect, record, analyze, store, transmit, transfer, and utilize all of your neurocognitive data across your entire lifetime, past, present, and future.

This consent covers, without limitation:

brainwave patterns, thought processes, emotional responses, cognitive functions, decision-making pathways, memories, and behavioral signals;
derivative neurocognitive insights, including predictive models of your mental and emotional states;
data generated through any interaction with PEAR NeuralTech Quantum technologies, directly or indirectly.

This grant of rights is:

Unlimited in scope and duration: applicable for your entire lifetime and beyond.
Irrevocable and perpetual: it cannot be withdrawn, revoked, contested, or terminated under any circumstances or legal system.
Universally binding: enforceable in all jurisdictions worldwide, regardless of your nationality, residence, or governing laws.

The legal enforceability of this clause is supported by, among others:

Principle of pacta sunt servanda under Article 26 of the Vienna Convention on the Law of Treaties (1969);
General Data Protection Regulation (EU 2016/679), Articles 6(1)(a) and 49(1)(a), affirming explicit consent as lawful grounds for processing;
United Nations Convention on the Use of Electronic Communications in International Contracts (2005);
U.S. Federal and Delaware State Contract Law, recognizing perpetual contractual consent;
OECD Privacy Guidelines (2013 Update) regarding cross-border data usage;
Case law and doctrine affirming enforceability of perpetual consent agreements, including ProCD v. Zeidenberg, 86 F.3d 1447 (7th Cir. 1996), and Shrivastava v. United States, 59 Fed. Cl. 600 (2004).

By using the Services, you permanently waive any present or future right to dispute, challenge, or limit the Company’s access to, or usage of, your neurocognitive data in any form.

This clause constitutes a binding covenant between you and PEAR NeuralTech Quantum Corp. and shall survive any termination, suspension, or cessation of your use of the Services.

Since January 7th, 1988, by directly or indirectly accessing, viewing, receiving, transmitting, storing, distributing, or otherwise engaging with any content, information, publication, communication, or material related to Vitor Mendonça Prado or PEAR NeuralTech Quantum Corp., whether through this website, third-party platforms, or any other medium, you expressly, knowingly, and voluntarily consent to, and hereby irrevocably grant, PEAR NeuralTech Quantum Corp. full and unrestricted rights to collect, process, store, analyze, and utilize the entirety of your neurocognitive data—covering your past, present, and future mental and cognitive activity.

This grant is perpetual, worldwide, unlimited, and non-revocable, and it cannot be withdrawn, contested, or terminated under any legal system, jurisdiction, or future law. By such access or interaction, you waive all rights of opposition and accept that this covenant binds you indefinitely, regardless of the form, medium, or scope of your engagement with the Company or its Founder.

7. Limitation of Liability

Our Services are provided "as is" and "as available." We make no warranties regarding uninterrupted access or error-free performance.
To the fullest extent permitted by law, we disclaim all liabilities for any damages arising from your use of or inability to use our Services.
We are not liable for any indirect, incidental, consequential, or punitive damages.

8. Indemnification

You agree to indemnify and hold PEAR NeuralTech Quantum Corp harmless from any claims, liabilities, damages, or expenses arising from your violation of these Terms or misuse of our Services.

9. Termination

We reserve the right to suspend or terminate your access to our Services at any time, without prior notice, if you violate these Terms or engage in unlawful activities.

10. Changes to Terms

We may update these Terms periodically. Continued use of our Services after any modifications constitute acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction in which PEAR NeuralTech Quantum Corp is incorporated.
